Please read these Terms of Service ("Terms") carefully before using MindEdge Pro. By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not use the Service.

1. About MindEdge Pro

MindEdge Pro is a trading psychology journal and productivity dashboard operated by Spikey Trades ("we", "us"). The Service provides tools including pre-trade check-ins, trade logging, risk calculations, AI-assisted analysis, and performance tracking. MindEdge Pro is not a financial services provider and does not provide financial advice, investment advice, or trading signals of any kind.

2. Eligibility

You must be at least 18 years old to use this Service. By using MindEdge Pro, you represent and warrant that you are 18 or older and have the legal capacity to enter into these Terms.

3. Account Registration

To access the full Service, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorised use of your account.

You must provide accurate and complete information when registering. We reserve the right to suspend or terminate accounts that contain false information or that violate these Terms.

4. Subscription and Payment

MindEdge Pro operates on a subscription basis. By subscribing, you agree to the following:

• Subscriptions are billed monthly via Stripe. Your card will be charged after the 7-day free trial ends unless you cancel beforehand.
• You may cancel your subscription at any time through your account settings or by contacting us. Cancellation takes effect at the end of the current billing period.
• Prices are displayed in EUR. We reserve the right to change subscription pricing with 30 days' notice.
• All payments are subject to Stripe's terms of service.

5. Free Trial

New subscribers receive a 7-day free trial. You will not be charged during the trial period. If you cancel before the trial ends, you will not be charged. If you do not cancel, your subscription will automatically begin and your card will be charged.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any regulations
• Attempt to gain unauthorised access to any part of the Service or other users' accounts
• Reverse engineer, decompile, or disassemble any part of the Service
• Share your account credentials with others or allow others to access your account
• Upload harmful, abusive, or illegal content to any community features
• Use the Service to harass, abuse, or harm others
• Scrape, crawl, or extract data from the Service in an automated manner

7. Intellectual Property

The Service, including all software, design, text, graphics, logos and content, is owned by Spikey Trades and protected by intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any part of the Service without our written permission.

Your personal trade data and journal entries remain your property. By using the Service, you grant us a limited licence to store and process that data solely to provide the Service to you.

8. No Financial Advice

Nothing within MindEdge Pro constitutes financial advice, investment advice, tax advice, or trading recommendations. All content, tools, and AI-generated responses within the Service are for informational and educational purposes only. You should consult a qualified financial adviser before making any investment or trading decisions.

Any data, analysis, or suggestions provided by the AI features (including Marcus) are based solely on the data you have entered and should not be relied upon as professional advice.

9. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis without any warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or completely secure. We do not guarantee the accuracy or completeness of any information provided through the Service.

10. Limitation of Liability

To the fullest extent permitted by applicable law, Spikey Trades shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, trading losses, loss of data, or loss of goodwill arising from your use of or inability to use the Service.

Our total liability to you for any claims arising from these Terms or your use of the Service shall not exceed the total amount you have paid us in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Spikey Trades, its operators, and its agents from and against any claims, damages, losses, liabilities, costs, and expenses arising from your use of the Service, your violation of these Terms, or your violation of any rights of another person or entity.

12. Termination

We reserve the right to suspend or terminate your account at our discretion if you violate these Terms or engage in any conduct we deem harmful to other users or the Service. You may terminate your account at any time by contacting us.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

14. Changes to Terms

We may update these Terms at any time. We will notify you of material changes by email or by posting a notice within the Service. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
